Waiver and permission to record and use
This includes and not limited to video coaching sessions, events, programs, interviews, video and audio recordings, submitted written material and/or photographs.  By participating, you expressly grant permission to utilize you in any testimonial, compilation, collective work and/or other derivative work created by using or incorporating content. You will not be compensated for any such use.

No repurpose, resale, repackage or reproduce
In connection with the services and products provided by Barbara Niven Enterprises, Inc. dba Show Business 101, Barbara Niven and/or Barbara Niven Enterprises, Inc. may furnish the client any or all of the following: home study programs, intellectual property and other such materials, and/or train client and customer in techniques, principles, methods, concepts or practices, or expose to non-public, confidential or proprietary information relating to the technology, expertise and trade secrets of Barbara Niven Enterprises, Inc. the client understands and agrees that any such materials, training or information will be furnished solely for its information and internal use in connection with the Work and may not be used for ANY other purpose or be disclosed, published, quoted, copied, condensed, paraphrased or delivered to any other party without the express written permission by Barbara Niven. This contract constitutes your agreement to not repurpose, repackage, reproduce or resale for any reason including any services, information or products provided from Barbara Niven Enterprises, Inc., Show Business 101 and/or Barbara Niven. It is further agreed that if the services, events programs, membership are terminated, this agreement shall survive such termination.

Refunds
Due to administrative costs, salaries, coordination activities, video equipment, materials printed, materials, acquisitions and all other business expenses incurred for our services, professional studio costs where applicable are non refundable 30 days after purchase date listed on this contract.

Systems, Services, Books and Programs
Any Barbara Niven Enterprises, Inc./Show Business 101 media or printed product (e.g., CDs, books, media coaching, consulting, services including professional studio, editing, developing content and message, learning systems, etc.) in its original condition may be returned to Barbara Niven Enterprises, Inc./Show Business 101 for a full refund or exchange within 30 days from the original purchase.  The original receipt or online order number is required for all returns and exchanges.  This does not include any software-based products or third party products or services.  These products and services performed are not returnable or refundable.

Any product missing the original packaging, packaging material, contents, accessories, and/or manuals (i.e. any product not in the “like new” condition and/or used) is not eligible for return or exchange.  Any product that is returned without promotional item (s) included with the original transaction and packaging in tact as in new (e.g., special report, promotional CD/DVD) will have the value of the promotional item deducted from the refund amount.

Services and Membership Plans
By participating in any programs, services and/or memberships delivered over a period of time, you agree to pay balance in full according to the terms outlined in our refund policies. Any services performed, rebooking fees, restocking fees will apply for services engaged.  There is a processing fee of $25 for each declined or delayed payment agreed upon in your contract.  Failure to complete the payment agreement as agreed will cause event, services and package prices to revert to current retail pricing.  Failure to honor agreement assigned will result in collection steps being taken.

Indemnification
You agree to defend, indemnify and hold harmless Barbara Niven, Barbara Niven Enterprises, Inc. and Show Business 101, its partners, vendors, associates, affiliates, consultants, and/or presenters from any claims, damages, costs and expenses, directly or indirectly resulting from, or caused by, either your failure to comply with the terms set forth herein, your participation in the seminar, any intentional or negligent action by the company, its partners, vendors, associates, affiliates, and consultants.
